What is probate?

Simply stated...it is a PROCESS using the Michigan probate court system to settle the estate of a deceased individual.  A Michigan probate attorney can help navigate this daunting process.  Some of the activities include:

  • *  appointing an executor (personal representative in Michigan)
  • *  finding and appraising all property and other assets of the deceased person
  • *  identifying all "heirs" of the deceased person (according to Michigan probate law)
  • *  discovering all debts (including taxes) of the deceased person and determining which ones to pay and which ones to withhold
  • *  distributing inheritances to heirs or people named in the Will (if there is a Will)
  • *  closing the estate with the Michigan probate court's approval

Who is an executor?

In Michigan, an executor is called a "Personal Representative."  This is a very important job as the personal representative has a legal duty to serve the estate.  Serving the estate means that all assets must be protected and safeguarded for the heirs and beneficiaries of the estate.  A Michigan probate attorney can help assure that the personal representative files all appropriate documents with the court and does everything necessary for a smooth administration of the estate.

Who needs probate?

It's simple, really.  Any person who owns property in his or her OWN NAME at death, will require probate.  It's the Michigan probate law.  And, by the way...if you have a Will, probate is still required.  A Will does not help you avoid probate at all.

Can probate be avoided?

Yes!  There are numerous ways to avoid probate in Michigan.  The best way is to have a conversation with a Michigan estate planning attorney to determine what works best for you and your family.  We offer free consultations to help you determine what is best for you...contact us today!
